Washington State Enforces Enforcement of Lead, Cadmium and Phthalates in Children's Products

On February 12, 2016, the Washington Department of Ecology issued guidelines for the enforcement of lead, cadmium, and phthalates in children’s products, clarifying the enforcement of lead, cadmium, and phthalates under the Child Safety Products Act (CSPA) The problem is that children’s products that are not covered by the Federal Act CPSIA need to meet the legislative requirements of Washington State.

 


    Washington State CSPA stipulates restrictions on lead, cadmium and phthalates in children's products. Compared with the federal regulation CPSIA, its definition of "children's products" is more extensive. Therefore, this guidance document states that Washington State has the right to regulate and control products that are not covered by CPSIA but meet the definition of "children's products" in CSPA.

     The following products are controlled by Washington State and are not covered by federal law:

    1. The limit of lead in car seat is 90ppm;

    2. The cadmium limit for clothing, footwear, jewelry, child care products and cosmetics (excluding cosmetics that are not part of toys) is 40ppm;

    3. The phthalate 6P limit for clothing, footwear, and cosmetics is 0.1%.
